Alina Habba has resigned as the US Attorney for New Jersey. This decision was prompted by a court battle that questioned her eligibility to hold the office.

Attorney General's Statement

The head of the Justice Department, Pam Bondi, announced Habba's resignation on the start of the week. Bondi stated that the appeals court finding made it unworkable for Habba to effectively run her office.

"Do not interpret adherence to the ruling as defeat," she declared. "My fight will now reach across the nation."

Habba's exit follows closely on a US appeals court ruled that she had been unlawfully serving as the top prosecutor. This ruling is could influence many criminal cases in the Garden State.

The appellate judges said that a acting appointment that did not receive confirmation by the US Senate breached the Federal Vacancies Reform Act.

Future Role and Reaction

It was also stated that Habba will stay on at the DOJ as a top consultant. Habba plans to seek further review of the disqualification, in the hope of achieving a different outcome.

In a statement, she wrote that judges "cannot be permitted to second-guess the appointment of attorneys tasked with executing the fundamental role of the presidency of enforcing the law."

The attorney general commended Habba's record and said that during her run, the city of Newark saw a significant drop in crime. Additionally that the city of Camden recorded its first summer in 50 years with no murders.

Background and Previous Role

Habba, 41, first joined Trump's personal legal team in recent years. She later defended the former president in his hush-money trial in 2024, leading to his conviction on 34 counts of financial record manipulation.

Prior to Habba took on the federal prosecutor position, Trump had stated he was naming her as his presidential counsellor during his second administration, describing her as "unwavering in her loyalty" and a "tireless advocate for justice".
